1. Who we are and what this agreement covers

These Terms of Use are an agreement between you and Evmetrics Ltd (United Kingdom), the developer and publisher of EvmetricsOBD, governing your use of the app on iPhone, iPad and Mac. By downloading, installing or using EvmetricsOBD, you agree to these terms. If you don't agree, please don't use the app. Questions can be sent to hello@evmetrics.co.uk.

How we handle the data the app reads from your vehicle is described separately in our Privacy Policy, which forms part of this agreement.

2. What EvmetricsOBD does

EvmetricsOBD connects to your vehicle through a Bluetooth, Wi-Fi or USB OBD adapter that you own, and reads diagnostic data such as sensor readings, battery and powertrain telemetry, trouble codes (DTCs), the vehicle identification number (VIN) and the odometer. It presents that data as live readings, charts, journey logs, workshop checklists and diagnostic reports. On iOS it also answers questions through Siri, Shortcuts and Spotlight, and where it is available in your version of the app, on supported devices, it includes an Assistant that answers questions about your car in plain English using a language model that runs entirely on your device.

3. Diagnostic disclaimer — please read this

EvmetricsOBD is a diagnostic aid, not a diagnosis. Vehicle sensors, adapters and communication protocols can and do produce incomplete, delayed or incorrect readings. Nothing in the app is professional automotive, electrical or safety advice.

This applies with particular force to the app's Assistant. Its answers are generated automatically by a language model and may be wrong, incomplete or misleading, even when they read fluently and cite real readings from your car. Treat them as a starting point for a conversation with a mechanic, never as a conclusion.

• Don't rely on the app as your sole basis for a repair, safety or purchase decision.
• Always have suspected faults confirmed by a qualified mechanic before acting on them, especially anything safety-related (brakes, steering, high-voltage systems, airbags).
• Don't use the app, or interact with your phone or the adapter, in a way that distracts you while driving.
• You're responsible for the physical connection of any adapter to your vehicle and for ensuring you're authorised to access the vehicle's diagnostic systems (e.g. it's yours, or you have the owner's permission).

To the fullest extent permitted by law, Evmetrics Ltd is not liable for any vehicle damage, missed or misdiagnosed fault, financial loss, or other harm arising from your use of, or reliance on, information shown in the app. See section 8 for the full limitation of liability.

4. Licence to use the app

Subject to these terms and Apple's Licensed Application End User License Agreement (which also applies where the app is distributed through the App Store), Evmetrics Ltd grants you a personal, non-exclusive, non-transferable licence to install and use EvmetricsOBD on devices you own or control, for your own personal or business vehicle-diagnostic use. You may not resell, sublicense, reverse-engineer, or use the app to build a competing product.

5. EvmetricsOBD Pro (subscription)

Some features require EvmetricsOBD Pro, an optional auto-renewing annual subscription purchased through your Apple Account.

• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription renews automatically each year unless auto-renew is turned off at least 24 hours before the current period ends.
• You can manage or cancel the subscription at any time in iOS/macOS Settings → your name → Subscriptions.
• Refunds are handled by Apple under its own refund policies — Evmetrics Ltd cannot issue refunds directly for App Store purchases.
• Pricing may vary by region and can change for future billing periods with notice as required by Apple's terms.

On macOS, where the app may be distributed outside the App Store, equivalent Pro features are unlocked without a StoreKit subscription; the diagnostic disclaimer and licence terms in this document still apply in full.

6. Third-party services

The app uses two third-party services: an optional VIN lookup against the US NHTSA vPIC database, off unless you turn it on, and (iOS only) anonymised usage analytics via Firebase. It also downloads a small settings file from our own website to check for updates. These are described in detail, including exactly what's sent and when, in our Privacy Policy. Evmetrics Ltd is not responsible for the availability or accuracy of these third-party services.

Where available, the app's Assistant runs on Apple's on-device Foundation Models and makes no network requests at all. EvmetricsOBD sends nothing to any AI service; the optional Google Gemini trouble-code research offered by earlier versions has been removed.

7. Trademarks

EvmetricsOBD is an independent app and is not affiliated with, endorsed by, or sponsored by Jaguar Land Rover Limited or any vehicle manufacturer. Jaguar, Land Rover, I-PACE and XF are trademarks of Jaguar Land Rover Limited. ELM327 is a trademark of ELM Electronics. Apple and CarPlay are trademarks of Apple Inc. All other trademarks are the property of their respective owners.

8. Disclaimer of warranties and limitation of liability

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including as to accuracy, reliability, fitness for a particular purpose, or that the app will be uninterrupted or error-free.

To the fullest extent permitted by law, Evmetrics Ltd's total liability to you for any claim arising from these terms or your use of the app is limited to the amount you paid for EvmetricsOBD Pro in the 12 months before the claim arose (or £0 if you used only the free tier). Evmetrics Ltd is not liable for any indirect, incidental, or consequential loss, including loss of vehicle use, lost profits, or vehicle damage. Nothing in these terms limits liability that cannot be limited under UK law (for example, liability for death or personal injury caused by negligence, or for fraud).

9. Termination

You can stop using the app and delete it at any time. We may suspend or terminate your licence to use the app if you breach these terms — for example, by attempting to reverse-engineer or resell it. An active EvmetricsOBD Pro subscription continues until you cancel it through Apple, independent of any termination of this licence.

10. Changes to these terms

We may update these terms from time to time, for example as the app gains features. The effective date at the top of this page reflects the latest revision; material changes to the diagnostic disclaimer or subscription terms will also be reflected in the app's App Store listing.

11. Governing law

These terms are governed by the laws of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections that apply in your country of residence.
